Experimental Technology & Smart Contract Risk

You assume the risks of engaging in transactions that rely on smart contracts and other experimental or evolving technologies. Transactions on Pingu.exchange rely on smart contracts deployed on one or more blockchains, cryptographic tokens generated by those contracts, and other decentralized systems that interact with blockchain-based networks.

These technologies are experimental, speculative, inherently risky, and subject to change. Among other risks, bugs, vulnerabilities, malfunctions, exploits, cyberattacks, or blockchain-level changes (e.g., forks) could disrupt these systems and may result in a total loss of digital assets, their value, or associated data.

You are solely responsible for the safekeeping of the private keys associated with any blockchain address used to interact with Pingu.exchange or the Protocol. We assume no liability or responsibility for any such risks or losses. If you are not comfortable assuming these risks, you should not access or engage in transactions using blockchain-based technology.

Immutability of Blockchain Records

One defining feature of blockchain technology is that its entries are immutable — meaning they cannot be deleted or altered by anyone, including us. This immutability applies to smart contracts, transaction data, and tokens generated by smart contracts.

THUS, TRANSACTIONS RECORDED ON THE BLOCKCHAIN — INCLUDING TRANSFERS OF CRYPTOASSETS AND DATA PROGRAMMED INTO SUCH ASSETS (SUCH AS REVENUE, INTEREST, OR REWARD ALLOCATIONS) — ARE PERMANENT AND CANNOT BE UNDONE BY US OR BY ANYONE ELSE. YOU MUST EXERCISE EXTREME CAUTION BEFORE FINALIZING ANY TRANSACTION THAT WILL BE BROADCAST TO THE BLOCKCHAIN.

Third-Party Services

We are not liable for any third-party services or links, including wallets, networks, or infrastructure providers. We are not responsible for the content, performance, or services of any third party — including, without limitation, wallet providers such as MetaMask, community platforms such as Discord, or hosting solutions such as IPFS.

The Pingu.exchange interface may be hosted on decentralized or third-party infrastructure. We have no control over such providers and assume no responsibility for any downtime, data loss, or actions or omissions by such third parties. Access to and use of any third-party products or services, including through Pingu.exchange, is entirely at your own risk.

Automated Smart Contract Execution

By using Pingu.exchange, you acknowledge and agree that all transactions are automatically processed via blockchain-based smart contracts. These contracts determine the logic and outcomes of all transactions, including how funds and ownership are allocated or distributed. You understand and consent that such smart contracts operate without human intervention, and their outcomes are final and irreversible.

Operational, Technical & Cybersecurity Risks

You acknowledge that Pingu.exchange and related blockchain systems may experience technical disruptions due to factors including, but not limited to:

  • network congestion or high on-chain activity;

  • software errors or protocol upgrades;

  • oracle or data-feed malfunctions;

  • denial-of-service or phishing attacks;

  • failures or interruptions of third-party infrastructure; or

  • other unpredictable technical or market events.

As a result, Pingu.exchange may become temporarily or permanently unavailable, and transactions may fail, be delayed, or behave unexpectedly. We disclaim any obligation to notify users of such risks or events. By using the Services, you accept full responsibility for these risks and agree that you will not hold any person or entity liable for any loss or damages arising therefrom.

Wallet Security

You are solely responsible for maintaining the security of your wallet, private keys, and devices. Any unauthorized access to your wallet could result in the loss or theft of your assets. We have no involvement in, and you will not hold us responsible for, the management, security, or recovery of your wallet or private keys. It is your responsibility to monitor wallet activity and safeguard your credentials.

Nothing on Pingu.exchange constitutes investment, trading, legal, or tax advice. You are solely responsible for conducting your own research and due diligence before interacting with the Protocol. You should not interpret any content or data available through Pingu.exchange as a recommendation to buy, sell, or hold any asset or to participate in any trading strategy.

Final Acknowledgement

By continuing to use Pingu.exchange, you acknowledge that you have read and understood this Risk Disclosure and accept all associated risks. You agree not to seek to hold Pingu.exchange, its developers, contributors, or affiliates responsible for any loss, damage, or claim arising from your use of the Protocol or the Site.
